Katie Holmes and Jamie Foxx - who have been rumored to be in a secret relationship for four years and counting - were finally photographed this week together exhibiting some PDA, holding hands on a beach in Malibu, Calif.

Over the Labor Day weekend, Jamie and Katie were caught holding hands while enjoying some precious time at the beach in Malibu in photos obtained by TMZ.

Radar Online reports that Holmes' divorce settlement with Tom Cruise allegedly contained a clause stating that the former Dawson's Creek actress could not publicly date anyone until five years had passed following the end of their marriage.

It has always been claimed that Tom included a strict clause in the divorce settlement that prohibited Katie from publicly dating anyone for five years. They reportedly stayed in an oceanfront home where they were also seen spending time together on the beachfront patio.

For years, the pair have dodged rumors that they were an item. Academy Award-winner Foxx, 49, sported a black or dark blue T-shirt and sweatpants while Holmes, 38, now appearing in "Logan Lucky" and upcoming in "Ocean's Eight", wore a loosefitting, below-the-knee, blue pattered dress.

"Katie doesn't think that Jamie has anything to feel bad about, but she knows it would mean a lot to him to clear the air with Tom", the source adds. A year before that, Foxx denied they were even a thing. Hello Katie and Jamie.

It has been assumed that the rumours of the ban on the past couple's dating have been true.

The divorce clause stopped Holmes to be seen romantically involved with anyone in public until June 2017. However, the pair has been firm in denying romantic ties between them.
