2nd federal judge orders Trump administration to accept DACA renewals

2nd federal judge orders Trump administration to accept DACA renewals

In fact, a recent court ruling has rendered that deadline meaningless.

It could also complicate Trump's own efforts in the courts.

The White House has sought increased funding for border security, including a wall across the U.S. -Mexico border, in exchange for providing a path to citizenship for 1.8 million immigrants.

If the Supreme Court now refuses to grant review of the Administration's speedy appeal of the controversy, that would mean that the two judges' orders against shutting it down would remain in effect.

In a tweet on Tuesday, Trump asserted that Democrats and Republicans must act now to provide legal protections to young "Dreamer" immigrants in the USA illegally.

The Justice Department said it maintains that the administration acted "within its lawful authority" in deciding to end DACA and will "vigorously defend this position".

Starting in early October, the department stopped accepting renewal applications from recipients whose benefits were set to expire by March 5.

Congress is trying to negotiate a plan to continue or modify DACA, but no breakthrough has been announced.

Roughly seven months into his term, Trump called for the program's end saying it was unconstitutionally established by President Barack Obama in 2012.

Garaufis' ruling in favor of Dreamers and a coalition of attorneys general led by New York Attorney General Eric Schneiderman is the latest twist in the status of DACA.

The plaintiffs had argued that the administration violated federal law by cutting off a program that hundreds of people relied on with little explanation.

Medical students are using their white coats and Ivy League credentials to fight for continuation of the Deferred Action for Childhood Arrivals (DACA) program.

Trump past year announced his plan to end DACA, the policy that allowed undocumented immigrants brought to the U.S. as children to stay in the country, effective March 5.

The judge's order to keep the program going was also based on his conclusion that there is not time enough for him and for higher courts to make a final decision on the constitutionality or legality of DACA prior to the scheduled shutdown. "For one thing, the President has stated his support for keeping DACA recipients in the country". And, of course, the Trump administration is fighting to overturn the rulings and go back to rejecting applicants.

Last month, Trump introduced a proposal that would put all 1.8 million young immigrants in question on a pathway to citizenship, in exchange for stiff cutbacks on overall immigration and funding for a massive wall on the United States border with Mexico. His framework for a deal is considered dead on arrival in Congress because of heavy opposition from Democrats and some Republicans to slashing legal immigration, but the president hasn't budged.
