Freeland emerged from trade talks Wednesday to say negotiators are "grinding through extremely intensively", but refused to divulge what Canada is putting on the table. ISDS protects USA investors, including oil and gas companies, from unfair treatment or asset seizures by host nations.

Earlier on August 29, the Trump administration's own anti-dumping duties on Canadian paper, used in books and newsprint, were thrown out by the U.S. International Trade Commission. After six years, though, the countries could decide to renew it for an additional 16. Under U.S. law, Trump must wait 90 days before signing the pact.

During a brief luncheon speech before a group of insurance representatives, Trudeau focused on the future impact of a new trade agreement on Canadians.

Freeland arrived in Washington on Tuesday and met that evening with Mexican officials, who briefed her on the preliminary, partial deal Trump announced Monday.

Progress toward repairing trade ties with allies comes as Washington's efforts to get trade talks with Beijing back on track have foundered.

Canada's dairy farmers operate under a protectionist system that manages supplies and prices, and imposes high tariffs to limit imports.

But Ottawa could offer U.S. dairy farmers a small increase in market share as it did with the European Union in a free trade pact past year, in exchange for United States concessions on the NAFTA chapter on dispute resolution.

Trudeau faces political pressure, from Quebec in particular, to give no ground on dairy. Rona Ambrose, who once led the Conservatives after Trudeau's election in 2015, urged him to dig in on the issue. "I think this is threat and bombast, but it is indicative of a very negative relationship between the White House and the Canadian government", Herman said.
